Five Stage Process
Marlin Valuation Process
Utilising proprietary databases and algorithms Marlin Legal Services evaluates the account and accountholder to determine a variety of indicators that are predictive of liquidations over time. A recommendation will be provided as to which accounts are likely to liquidate at a higher rate as a result of legal collections strategies and a corresponding budget to be approved by the client prior to the commencement of the litigation process.
Pre-litigation Administration
Marlin Legal Services will obtain all account information that will be required throughout the legal collections process and load this into the proprietary ENFsys account management system. When instructed by the client to issue proceedings, Marlin Legal Services will provide solicitors access to the accounts on ENFsys and a Letter Before Claim will be issued by them to warn the debtor of impending legal action. At this stage the accountholder will also be contacted to determine whether any settlement can be agreed, within client defined parameters, to avoid litigation.
Securing Judgment
If settlement is not achieved with accountholders, solicitors will electronically issue proceedings at Northampton County Court Bulk Processing Centre. ENFsys is updated daily with the judgments received and the experienced collection agents at Marlin Legal Services will use the judgement to seek further payments from accountholders. During this stage in the process a certain number of debtors will settle in full or commit to regular payment plans. If any accountholders defend the claim against them, solicitors will take appropriate action, seeking instructions through Marlin Legal Services where necessary and thereby enabling focused communication between the client and Marlin Legal Services.
Enforcement of Judgment
If reasonable payment offers are not obtained from accountholders following judgment, the cases are transferred to a county court which has an enforcement team dedicated to processing enforcement orders for clients of Marlin Legal Services. A pre-determined enforcement method, determined to be most suitable to the accountholders circumstances according to the Marlin Valuation Porcess, will be sought in order to prompt payments under the judgment.
Post-enforcement Administration
Once the enforcement order has been obtained, Marlin Legal Services works with the debtor to determine payment amounts, whether by regular instalments or by settlement of the debt according to client instructions. If the credit agreement provides for it, interest can be applied to the accounts. |
